Can Li Yixue Fly Over the Cuckoo's Nest?

Involuntary mental health treatment cases frequently occur in recent years. Here is a widely known and discussed case happening to Li Yixue in Jiangxi. On 21 April 2022, Li Yixue was sent by the public security authority to the Psychiatric Hospital of Jiangxi Province and hospitalized for mental health treatment (for the first time). After leaving the hospital, Li Yixue brought an action against the hospital by claiming that she was mentally normal and forced to undergo the mental health treatment. This case has not been decided yet. On 22 December 2024, the police announced that Li Yixue was diagnosed as having obsessive compulsive personality disorder and legally sent to hospital (for the second time). It is unclear whether Li Yixue is still in psychiatric hospital. Is she really mentally ill? Answers to this question differ. This article discusses whether it is lawful to force Li Yixue to go to and receive medical treatment in hospital, not her “condition”......................More

Analysis of New Rules on Non-compete Restrictions in China and the US - Exploring Ways to Protect People’s Freedom to Choice of Jobs

Most of non-compete restriction cases that I advised on have negative social outcomes because non-compete rules limit a person’s choice of jobs, one of the fundamental human rights of freedom. Abuse of non-compete rules arouses feelings of hatred. Both China and the United States published regulations against abuse of non-compete restrictions in April 2024. In the new guide to law application in real cases issued by the People’s Supreme Court of China, only minor changes were made against abuse of non-compete restrictions. In the new rules issued by the US Trade Commission, the old non-compete restrictions were basically abolished in a way that might not be allowed by law and was unsuccessful in the initial phase.........................More
